The Office of Estate Administration Unit, within the Oregon Department of Human Services is seeking to hire Two Assistant Estate Administrator, Compliance Specialist 2. You will determine which policies affecting estate assets were/are following existing eligibility policy standards. You will determine which laws, rules and policies apply to the known facts, and initiate the appropriate action to be taken. You will determine if an eligibility violation has occurred and make decisions based on compliance enforcement. Two of the four years must be above the technical support level. (Note: some positions may require experience in a specific regulatory industry or program)Note: college-level course work may substitute for experience on the basis of 45-quarter units per year, up to a maximum of three years.Required: Required: Submit a cover letter no longer than 2 pages long that clearly describes the two questions below. Please provide your experience researching, analyzing, and applying administrative rules, statutes, and regulations.Please describe your experience preparing written correspondence to a variety of audiences.Failure to submit the required cover letter may remove your application from consideration.Your duties at a glanceAs the Assistant Estate Administrator, you will: Enforce estate recovery and act as a liaison between the Department and other parties using and interpreting established laws, policies, and regulations. Receive notifications of death from the public, branch offices, attorneys, nursing facilities, other providers, court records. Evaluate case record, legal, and service documents pertaining to the deceased and/or Living Medicaid recipient that are transferred or referred to the unit, to determine that policies affecting estate assets were/are following existing eligibility policy standards and to identify if there are recoverable assets upon which a claim may be made. Investigate complaints, and/or assists field unit staff, regarding questionable asset actions on the part of the client/representative/family member, to determine if an eligibility violation may have occurred. Identify if overpayment of benefits exists, assets not disclosed, creditors not paid in priority order, possible financial abuse. Testify at contested, administrative case hearings or court hearings. Design and provide training to agency employees and/or other governmental or non-governmental entities explaining estate recovery regulations. TThe position has significant independence and discretion in interpreting and applying complex regulations and to refer, in concert with the estate administrator and management, cases for possible sanctions and/or other remedies to the Department of Justice.Essential attributesWe are looking for candidates with:Knowledge of research and investigative practicesAbility to analyze, interpret and apply rules and applicable statutesKnowledge of the legal process related to probate lawKnowledge of real estate, banking, Medicaid eligibility, and title experienceThe ability to proactively and effectively communicate, verbal and written information with internal and external partnersAbility to multi-task, prioritize work, independent decision making, identify issues & solve problems, high degree of accuracyWork effectively and collaboratively as part of a diverse teamPlease be sure to clearly describe how you meet these attributes within your application materials. Travel may be required occasionally throughout the state to provide training, provide testimony, or inspect estate property.May occasionally encounter hostile or emotionally upset individuals.May require some bending, stooping, and lifting associated with working with file drawers/boxes.The person in this position must have a good driving record or be able to provide an acceptable alternative means of transportation.An option for Hybrid work will be dependent on location when filling this position. The ability to report to Salem may be required when training, business or operational needs are dependent on onsite activities. About Estate Administration UnitThe Estate Administration Unit (EAU) is a unit within the Office of Payment Accuracy and Recovery (OPAR) that is part of Administrative Services within the Department of Human Services. The Department serves Oregonians by administering, providing, and promoting a variety of programs. The Department has responsibility for medical and cash assistance, electronic benefit food issuances, long term care and community-based care waivered services, adult protective services, children's services, licensing and certification of facilities, estate administration, Older Americans Act, Oregon Project Independence, and many other services that assist people. The EAU has responsibility for a wide variety of duties related to the recovery of assistance from the estates of deceased clients. The unit is also involved in providing technical assistance to field units on such topics as property transfers, wills, trusts, conservatorships, guardianships, and other legal documents and proceedings. The unit assures that federal and state laws and administrative rules are complied with in the recovery of public assistance benefits.
