Join us and make a difference.The role of Associate Director, Sourcing Excellence (SE), Contracting within the Strategic Sourcing & Procurement (‘Procurement’) function, will be responsible for the delivery of an industry-leading contracting capability through the efficient conduction of dedicated contracting, including but not limited to active contract review, issue identification and analysis, redlining, and negotiation. It will be key for this individual to serve as the gatekeeper and manage escalations in the contracting process prior to final review and where appropriate approval by the legal department.The individual in this role must be able to handle a heavy workload with sometimes short and/or expedited deadlines. The successful candidate must (1) create and develop organic relationships with stakeholders  (2) actively work and manage the entire contract from start to finish with a hands on approach, and (3) provide periodic training to lesser experienced contract and sourcing professionals.Major Responsibilities and Accountabilities:Drive and Conduct contract facilitation process for highly complex contractsSupport any required pre-transactional steps and prior endorsement, with appropriate risk assessment due diligence as neededExecute contracts in a timely manner with appropriate legal support to ensure compliance with company standardsPerform appropriate due diligence by issue spotting and assessing risk mitigating options.Coordinate and perform contract analysis, including redlines and negotiations with legal and other stakeholders as well as suppliers to:Negotiate business terms and collaborate, coordinate, and be able to explain risks and implications of contract terms to the business and other stakeholders. Complete gap analyses, review, redline, and understand contract language, risks and implications of such language.Draft commercial terms as neededDefend legal terms on standard internal templates, agreements and third-party paper where necessary.Drive resolution of contract issues in a timely mannerEnsure key agreements and contracts are reviewed by peers and superiors to protect and advance the company’s interestsCollaborate with cross-functional teams to enable the procurement contracting process and ensure excellence in contract managementCollaborate with BMS Legal in its development, oversight, and maintenance of relevant contract templates, fallback language, and guidance documents in continually improving an efficient and effective Procurement contracting functionIdentify points of escalation for Sourcing Excellence (‘SE’) to interface with Strategy, Process & Capabilities, Legal, and other relevant stakeholders (e.g., Compliance, Audit, etc.,) regarding contracting and Procurement policy and related operational questionsSupport continuous improvement initiatives towards an industry-leading contracting capability within Strategic Sourcing & ProcurementParticipate in, create and deliver training to provide opportunities for professional development and further expansion of contracting skillsetsEnsure thresholds and hand-offs between Business, Legal, and other involved parties are clear and well communicatedPartner with functional / regional category teams to maintain effective contracting procedures and ensure adherence to regional/global category strategiesQualifications:Minimum Requirements:B.S./B.A. or equivalent degreeJD (Juris Doctorate) required6-8 years of relevant experience including drafting, redlining, reviewing and negotiating procurement / business contracts, procurement negotiations (preferably in Pharmaceutical or Life Sciences industries [or other regulated industries])Internal stakeholder management, data/information management, category management, process redesign and continuous improvement expertise, project management and performance measurement skillsProcurement process knowledge, contract management, financial analysis, market analysis, supplier analysis, supplier diversity, supplier management, technology utilization, strategic planning, and integrated supply chain experiencePreferred Qualifications:Preference for candidates having experience with emerging and disruptive digital technologies and data solutions applicable across all business units of IT and/or R&DExperience managing cross-functional and/or global teams of contracting and / or procurement professionals and in establishing performance expectationsUnderstanding of legal terms vs. business termsUnderstanding of Data Privacy and Health Data Privacy laws, regulations and considerations3 years of Pharmaceutical Procurement experienceMembership in Professional Associations (e.g., ABA, NCMA)Around the world, we are passionate about making an impact on the lives of patients with serious diseases.
