Madison Avenue Support Services, Inc is a government contractor looking for Vocational Rehab Counselors/Experts who are willing to work as a witness for SSA in regard to appealing denial of benefits by SSA. This can be a full or part time position, depending on your schedule.
We are in need of vocational expert (VE) witnesses for in hearings before an Administrative Law Judge (ALJ) appealing denial of certain benefits administered by SSA. This position is throughout the US in addition to Guam, Puerto Rico, U.S. Virgin Islands and American Samoa. These hearings are administrative proceedings and do not take place in a court of law.
The hearings can be made in person, teleconference (phone or video).
SERVICES TO BE PROVIDED:
VE Study
Prior to the hearing, the VE must conduct a review of the relevant portions of the claims file or other evidence provided in a manner consistent with the VE Handbook (to be provided). The VE must comply with all subsequent versions of the VE Handbook. The VE must be familiar with the evidence such that the VE is able to respond immediately to an ALJ during the hearing.
VE Remand Study
The VE must review the relevant portions of the claims file or other evidence provided. The VE must be familiar with the relevant portions of the claims file or other evidence provided and related issues such that the VE is able to immediately respond to an ALJ during the hearing.
VE Testimony at ALJ Hearing
The VE participates in the hearing before an ALJ and provides the results of his or her study. The VE also must provide testimony at the hearing in a manner consistent with the VE Handbook and all resources cited in the VE Handbook, and be prepared to provide immediate responses to the ALJ’s questions. The VE should be prepared to cite, explain, and furnish citations to any sources relied on to support the VE’s testimony, whether provided at a hearing or via interrogatories.
Interrogatories
Interrogatories are written questions the ALJ may ask the VE to answer in writing rather than obtaining VE testimony at a hearing. The agency may require the VE to answer the interrogatories either before or after a hearing. The VE must respond to interrogatories by uploading their responses in Electronic Records Express (ERE) for Experts.
The ALJ will direct the VE to provide completed interrogatories within a certain timeframe via ERE; but at a minimum, the VE will have 10 days to provide a response. The VE must conduct a review of the relevant portions of the claims file or other evidence provided by OHO and prepare well-supported interrogatory responses in a manner consistent with the VE Handbook. The VE should be prepared to cite, explain, and furnish any sources relied on to support the VE’s testimony, whether provided at a hearing or via interrogatories.
QUALIFICATIONS
Qualifications to Provide Service as a VE
VEs must be individuals with the ability to provide impartial expert opinions relevant to the evidence contained in the claim file, and testimony provided at an ALJ hearing. Areas of expertise must include current knowledge of working conditions and physical and mental demands of various occupations; transferability of skills; knowledge of the existence and numbers of jobs at all exertional levels in the national economy; and involvement in or knowledge of placing individuals with disabilities into jobs.
To ensure all individuals serving as a VE have the knowledge, skills and ability to provide expert opinions, all VEs must meet and maintain all of the following requirements:
1. At least five years of direct experience providing vocational rehabilitation services to individuals with disabilities,
2. Current national certification as either a Certified Rehabilitation Counselor (CRC) by the Commission on Rehabilitation Counselor Certification (CRCC), or National certification as a Fellow or Diplomate by the American Board of Vocational Experts (ABVE), and
3. Meet the continuing educational requirements of their national certifications from either the CRCC or ABVE.
Special Requirements -- Puerto Rico Hearings
SSA will conduct all cases where the claimant resides in Puerto Rico in Spanish. The VE who participates in these hearings must be fluent in Spanish and able to provide immediate responses to ALJs in Spanish during these hearings .
Government contract so position will not start immediately. Most likely within 60 days. Resume must reflect vocational experience and/or education (Masters in Social Work, etc.)
